Columbus — Attorneys for a man accused of killing his pregnant wife and two children in 1985 this week filed briefs in favor of charges being dismissed.
They argue Michael Curry’s right to a speedy trial has been violated.
Curry pleaded not guilty last August to all charges against him, including murder, aggravated assault and feticide in the bush-ax slayings of his pregnant wife, Ann, 4-year-old daughter Erika and 1-year-old son Ryan.
Curry was interviewed by Columbus police at the time of the deaths but was not arrested until May, after a grand jury indicted him.
In briefs filed Thrusday and Friday, his lead attorney, public defender Robert Wadkins, maintains that the 24-year delay between then and when cold case investigators presented evidence to a grand jury violated his rights.
