Federal judge stops school board election

Albany — U.S. District Court Judge W. Louis Sands has granted a preliminary injunction, suspending the use of the district configurations of the 2000 census and subsequently the elections set for July for Districts 1,2,4 and 6 of the Sumter County Board of Education.

A lawsuit against the Sumter County Board of Education and its individual members, and the Sumter County Board of Elections and Voter Registration was filed in May in the U.S. District Court for the Middle District of Georgia on behalf of William Bird of Americus.

Representing Bird, William W. Calhoun challenged the constitutionality of the Sumter County Board of Education districts, claiming that the districts violate the principle of “one person, one vote.” The lawsuit claims that the current districts, as drawn, are of disproportionate sizes.

Calhoun spoke with the Times-Recorder Friday, stating that the case was “straight forward” from his perspective. In the preliminary hearing Calhoun presented evidence of the malapportioned districts from data he obtained fromt the State Legislative and Congressional Reapportionment Office and a few tecnical issues

“That’s the principle issue;” Calhoun said,” the existing districts are malapportioned.”

The decision from the judge obtained by the Times-Recorder Friday states that the case will move forward and all parties involved will be notified for scheduling of an evidentiary hearing.

“I think the court will move quickly on this,” Calhoun said, adding that he expects that the court intends to have the issue resolved so elections will be allowed to go forward on Nov. 6.
